Welcome to PRIMIUMSHERA.

These Terms of Service (“Terms”) govern your access to and use of the PRIMIUMSHERA website, including https://primiumshera.com/ (the “Site”), and your purchase and use of products offered through the Site.

The Site is operated by PRIMIUMSHERA, based in Palanpur, Gujarat, India.

By accessing the Site, browsing our products, placing an order, or otherwise using our services, you acknowledge that you have read and understood these Terms and agree to comply with them, together with our Privacy Policy, Refund & Return Policy, Shipping Policy, and other policies published on the Site.

If you do not agree with these Terms, please do not use the Site or place an order.

SECTION 1 – ACCESS AND ELIGIBILITY

You may use the Site only for lawful purposes and in accordance with these Terms.

By placing an order, you represent that:

  • The information you provide is accurate and complete;

  • You have the legal capacity to enter into a transaction under applicable law; and

  • You are authorized to use the payment method provided for the order.

If you are using the Site on behalf of another person, you represent that you have the authority to do so.

Parents or legal guardians should supervise minors' use of online shopping services where appropriate.

PRIMIUMSHERA may require additional information or verification where reasonably necessary to process an order, verify a transaction, prevent fraud, or comply with applicable law.

SECTION 2 – OUR PRODUCTS

We make reasonable efforts to ensure that product descriptions, photographs, specifications, prices, and other information displayed on the Site are accurate and useful.

However:

  • Product colours may appear differently depending on your device, screen, display settings, or lighting.

  • Minor variations in appearance, packaging, or presentation may occur.

  • Product availability may change from time to time.

  • Product specifications may change where permitted and where such changes do not materially misrepresent the product offered.

  • Images may be used for illustrative purposes where appropriately indicated.

We do not intentionally misrepresent the nature, quality, characteristics, or functionality of products.

If a product received does not correspond materially with the product ordered or is defective, the customer may have rights under our Refund & Return Policy and applicable law.

SECTION 3 – ORDERS

When you place an order through the Site, you are submitting a request to purchase the selected products.

An order may be subject to payment confirmation, availability, address verification, COD verification, fraud-prevention checks, and other reasonable order-processing procedures.

PRIMIUMSHERA may decline or cancel an order in circumstances such as:

  • The requested product is unavailable;

  • The delivery address is unserviceable;

  • Payment cannot be successfully processed;

  • A COD order cannot be reasonably verified;

  • There is a reasonable indication of fraudulent, unauthorized, or abusive activity;

  • There is a genuine and material error in product information or pricing; or

  • Fulfilment is otherwise prevented by circumstances beyond our reasonable control.

Where an order is cancelled after payment has been received and a refund is due, the applicable refund will be processed in accordance with our Refund & Return Policy and applicable law.

We will not use an order-cancellation provision to improperly avoid a customer's statutory consumer rights.

Customers should review their order details carefully before completing the purchase.

SECTION 4 – PRICES AND BILLING

Product prices displayed on the Site are stated in Indian Rupees (INR) unless otherwise indicated.

PRIMIUMSHERA is currently not registered under GST. Accordingly, we will not represent ourselves as GST-registered or provide a GSTIN that we do not have.

Prices and product availability may change from time to time. Any change will not retrospectively alter the price of an order that has already been validly accepted and processed, except where correction is required because of a genuine error or where otherwise permitted by law.

Shipping is currently offered free across India for our standard deliveries.

By submitting payment information, you confirm that you are authorized to use the relevant payment method.

Available payment methods include:

  • Card

  • UPI

  • Net Banking

  • Cash on Delivery (COD)

Online payments may be processed through PhonePe.

Promotional offers, discounts, or special pricing may be subject to additional terms displayed with the relevant offer.

SECTION 5 – SHIPPING AND DELIVERY

PRIMIUMSHERA currently offers Pan-India shipping to serviceable locations.

Orders are shipped through Shiprocket and its applicable logistics/courier network.

The estimated delivery time is generally 3–5 days, subject to the delivery location and operational circumstances.

Delivery estimates are not absolute guarantees and may be affected by circumstances including:

  • Courier or logistics delays;

  • Weather;

  • Natural disasters;

  • Transportation disruptions;

  • Public holidays;

  • Incorrect or incomplete address information;

  • Customer unavailability; or

  • Other circumstances beyond our reasonable control.

Customers are responsible for providing accurate delivery and contact information.

SECTION 6 – RETURNS, REFUNDS AND EXCHANGES

Returns are governed by our Refund & Return Policy, which forms part of these Terms.

Under our current policy, returns are generally considered for:

  • Wrong products; and

  • Defective products.

Return requests must generally be made within 3 calendar days from delivery and are subject to the applicable verification and evidence requirements.

An unboxing video is required as important evidence for wrong-product, damaged-product, and defect-related claims.

Exchange is currently available for wrong products, subject to verification and availability.

Approved refunds are generally processed to the original payment source for prepaid orders and through an appropriate bank-transfer or UPI method for COD orders.

Refunds are generally credited within 8–15 business days after approval, subject to applicable payment-provider and banking timelines.

Nothing in these Terms is intended to exclude or restrict a consumer right or remedy that cannot lawfully be excluded or restricted.

SECTION 7 – INTELLECTUAL PROPERTY

Unless otherwise stated, the content appearing on the Site, including text, product descriptions, graphics, logos, photographs, design elements, page layouts, and other original materials, is owned by, licensed to, or lawfully used by PRIMIUMSHERA or the relevant rights holder.

You may access and use the Site for personal and lawful shopping purposes.

You may not, without appropriate authorization:

  • Copy substantial portions of the Site;

  • Reproduce or republish our original content commercially;

  • Use our branding or logos in a manner suggesting affiliation or endorsement;

  • Modify or commercially exploit our copyrighted materials; or

  • Scrape, systematically extract, or reproduce Site content for commercial purposes.

Nothing in these Terms transfers ownership of intellectual property rights to you.

Shopify's intellectual property remains the property of Shopify or its applicable rights holders.

SECTION 8 – THIRD-PARTY SERVICES AND TOOLS

Our Site may use or provide access to third-party services, applications, technologies, payment systems, logistics services, or other tools.

Such third-party services may be subject to their own terms and privacy policies.

Where a third-party service is necessary for a transaction or service, your use of that service may also be governed by the third party's applicable terms.

PRIMIUMSHERA does not control every aspect of third-party services and is not responsible for matters that are solely within the control of the relevant third-party provider, subject to applicable law.

SECTION 9 – THIRD-PARTY LINKS

The Site may contain links to websites or services operated by third parties.

These links may be provided for convenience or informational purposes.

PRIMIUMSHERA does not necessarily endorse third-party websites, products, or services and does not control their content, privacy practices, security, or terms.

If you access a third-party website, you do so subject to that website's own terms and policies.

SECTION 10 – RELATIONSHIP WITH SHOPIFY

Our online store is hosted and powered by Shopify.

Shopify provides the technology and e-commerce infrastructure that enables us to operate our online store.

However, your purchase of products from PRIMIUMSHERA is a transaction between you and PRIMIUMSHERA.

Shopify is not the seller of the products offered by PRIMIUMSHERA and is not responsible for the quality, condition, delivery, returns, refunds, or other aspects of products purchased from PRIMIUMSHERA, except to the extent required by applicable law or arising from Shopify's own services.

SECTION 11 – PRIVACY

Your use of the Site is also governed by our Privacy Policy.

We collect and process personal information as described in that Privacy Policy, including information necessary to process orders, payments, delivery, customer support, returns, refunds, security, and other legitimate business purposes.

Because our store is powered by Shopify and uses third-party service providers such as PhonePe and Shiprocket, personal information may also be processed by those providers as necessary to provide their respective services.

SECTION 12 – CUSTOMER REVIEWS AND FEEDBACK

If you voluntarily submit reviews, comments, suggestions, feedback, photographs, or other content relating to PRIMIUMSHERA or its products (“Feedback”), you represent that:

  • You have the right or authorization to submit the content;

  • The content is not knowingly false or misleading;

  • The content does not unlawfully infringe another person's rights;

  • The content does not contain unlawful, abusive, threatening, defamatory, or malicious material; and

  • The content does not contain personal information of another person without appropriate authorization.

By submitting Feedback, you grant PRIMIUMSHERA a non-exclusive, royalty-free permission to use, reproduce, display, publish, and adapt that Feedback for legitimate business, customer-service, website, and marketing purposes, subject to applicable law.

We reserve the right to remove or decline to publish Feedback that violates these Terms or applicable law.

SECTION 13 – ERRORS, INACCURACIES AND OMISSIONS

We make reasonable efforts to keep information on the Site accurate and current.

However, there may occasionally be typographical errors, inaccuracies, omissions, or outdated information relating to product descriptions, availability, prices, promotions, or other Site content.

Where we identify a genuine error, we may correct the information.

If an error materially affects an order that has not yet been fulfilled, we may contact the customer to explain the issue and, where appropriate, provide the available options, including cancellation and refund where applicable.

We do not intend to use this provision to deprive customers of rights provided under applicable consumer law.

SECTION 14 – PROHIBITED USES

You must not use the Site:

  • For any unlawful purpose;

  • To commit or facilitate fraud;

  • To impersonate another person;

  • To submit knowingly false information;

  • To interfere with the operation or security of the Site;

  • To introduce malware, viruses, or other harmful code;

  • To attempt unauthorized access to systems or accounts;

  • To scrape or collect personal information unlawfully;

  • To abuse customer-service or return/refund processes;

  • To infringe intellectual-property rights;

  • To harass, threaten, or abuse our employees, representatives, or other users; or

  • In any manner that violates applicable law.

We may restrict or suspend access to the Site where reasonably necessary to protect the Site, our business, customers, or other users, subject to applicable law.

SECTION 15 – SUSPENSION AND TERMINATION

We may restrict or suspend access to portions of the Site where reasonably necessary because of security concerns, misuse, fraudulent activity, unlawful conduct, technical issues, or other legitimate reasons.

Termination or suspension of access does not affect rights and obligations that accrued before termination.

Provisions concerning intellectual property, privacy, dispute resolution, liability, and other provisions that by their nature should continue will remain effective to the extent permitted by law.

SECTION 16 – PRODUCT AND SERVICE DISCLAIMERS

We make reasonable efforts to ensure that the Site operates properly and that product information is accurate.

However, we do not guarantee that:

  • The Site will always be available without interruption;

  • The Site will always be free from technical errors;

  • Every product will remain continuously available; or

  • Electronic communications will always be transmitted without delay or error.

Products are sold subject to their applicable descriptions, specifications, warranties, guarantees, and applicable law.

Nothing in these Terms excludes any warranty, guarantee, consumer right, or remedy that cannot legally be excluded or restricted.

SECTION 17 – LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, PRIMIUMSHERA will not be responsible for losses that are remote, indirect, incidental, or consequential and that could not reasonably have been anticipated from the relevant transaction.

However, nothing in these Terms limits or excludes liability where such limitation or exclusion is prohibited by applicable law, including liability arising from rights or remedies that cannot legally be waived.

These Terms do not limit statutory consumer protections available under applicable Indian law.

SECTION 18 – CUSTOMER INDEMNIFICATION

To the extent permitted by applicable law, you agree to be responsible for losses, claims, or reasonable costs directly arising from:

  • Your unlawful use of the Site;

  • Your intentional misuse of our services;

  • Your material breach of these Terms; or

  • Your infringement of another person's legal rights through content or information you submit to us.

This provision does not require you to indemnify PRIMIUMSHERA for losses caused by PRIMIUMSHERA's own unlawful conduct, negligence, or breach of non-excludable legal obligations.

SECTION 19 – SEVERABILITY

If any provision of these Terms is determined by a competent authority or court to be unlawful, invalid, or unenforceable, that provision will be interpreted or modified to the minimum extent necessary where legally permissible.

If it cannot be so modified, it may be severed from these Terms.

The remaining provisions will continue to apply to the extent permitted by law.

SECTION 20 – WAIVER AND ENTIRE AGREEMENT

A failure by PRIMIUMSHERA to enforce a provision of these Terms on one occasion does not constitute a permanent waiver of that provision or any other right.

These Terms, together with the applicable policies published on the Site, constitute the terms governing your use of the Site and purchases from PRIMIUMSHERA, subject to applicable law.

Where a specific written agreement or legally binding statutory requirement conflicts with these Terms, the applicable agreement or legal requirement will prevail to the extent of the conflict.

SECTION 21 – ASSIGNMENT

You may not transfer your contractual rights or obligations under these Terms to another person where such transfer would materially affect our ability to perform the transaction, unless permitted by law or agreed by PRIMIUMSHERA.

PRIMIUMSHERA may transfer or assign its rights or obligations in connection with a legitimate business restructuring, transfer of business, or similar transaction, subject to applicable law and any rights that cannot lawfully be transferred.

SECTION 22 – GOVERNING LAW AND JURISDICTION

These Terms are governed by the laws of India.

Subject to applicable consumer-protection laws and the jurisdiction available to a consumer under applicable law, disputes arising from the use of the Site or purchases from PRIMIUMSHERA may be subject to the jurisdiction of the competent courts and consumer forums/commissions having jurisdiction over the matter.

Nothing in this clause is intended to prevent a consumer from exercising a statutory right to approach a consumer commission or other authority that has jurisdiction under applicable law.

SECTION 23 – CHANGES TO THESE TERMS

PRIMIUMSHERA may update these Terms from time to time to reflect changes in our business, Site functionality, services, or applicable legal requirements.

The updated Terms will be published on this page with a revised effective date.

Your continued use of the Site after an update may constitute acceptance of the revised Terms to the extent permitted by applicable law.

For purchases already completed, the version of the applicable terms and policies in force at the relevant time will continue to apply to the extent required by law.

Important changes from your reference

I deliberately did not carry over a few provisions literally:

  • “Risk and title pass upon dispatch” — removed because a blanket transfer can create unnecessary consumer-law issues, particularly where delivery, wrong-product, defect, or damage issues remain relevant.

  • Absolute “as-is” disclaimers — qualified so they don't purport to waive non-excludable consumer rights.

  • Unrestricted order cancellation — narrowed to genuine circumstances such as unavailability, material errors, fraud concerns, or inability to fulfil.

  • Jurisdiction limited to Gujarat courts — replaced with a formulation preserving applicable consumer jurisdiction rights.

  • GSTIN — omitted because you confirmed PRIMIUMSHERA is not GST registered.

  • Shopify liability language — retained in substance but rewritten so PRIMIUMSHERA's commercial responsibility isn't obscured by Shopify's involvement.
